Hemle35 — Music Video Production

1. General Information

2. Our Services

Hemle35 provides professional music video production services, including filming, camera and lighting equipment, and optional editing and post-production.

Each package includes only the services specifically described in the selected offer or booking confirmation.

Our standard packages may include:

Up to 6 hours of shooting
A professional two-person production crew
Professional camera and lighting equipment
Delivery of usable footage
Professional editing and color grading, where included

Additional services, shooting hours, or special production requirements can be arranged separately.

3. Booking & Confirmation

Bookings can be requested through our website or by contacting us directly.

A booking becomes binding when Hemle35 confirms the order and the agreed services in writing or through the booking platform.

All bookings are subject to availability.

If an online payment has been collected but we cannot accept the booking, the payment will be refunded.

Unless explicitly stated otherwise, our production packages are one-time services, not recurring subscriptions.

4. Pricing & Payment

The total price and any applicable taxes will be displayed before the customer completes the booking.

Full payment is required upfront to secure a confirmed booking.

Payment can be made using the payment methods available through our website or agreed upon individually.

Additional costs will only be charged when they have been communicated and agreed upon in advance.

5. Planning & Preparation

We want to keep the production process as simple as possible.

Clients are responsible for providing the necessary project information, including their creative concept, music, preferred shoot date, and other relevant requirements.

Any permissions required for filming locations, performances, or materials provided by the client must be arranged by the client unless otherwise agreed.

Hemle35 will coordinate the production details with the client before the shoot.

6. Shooting & Production

Shooting times and production arrangements will be agreed upon before the project begins.

Any additional shooting time must be approved by both parties and may involve additional charges.

We aim to deliver professional, high-quality results consistent with the agreed creative brief. However, specific artistic or commercial outcomes cannot be guaranteed.

7. Editing & Revisions

Editing and color grading are only included in packages that specifically mention these services.

The number of included revisions, if any, will be specified in the selected package or individual agreement.

Additional changes outside the agreed scope may involve additional costs, subject to the client's prior approval.

8. Delivery of Footage

Footage and completed videos will be delivered digitally in an agreed format.

Estimated delivery timelines will be communicated before production.

For packages without editing, we provide the usable recorded footage agreed upon for delivery. Unusable takes, internal project files, and editing project files are not included unless expressly agreed.

If unexpected circumstances affect delivery, we will inform the client promptly. Statutory rights relating to delays and defective performance remain unaffected.

9. Copyright & Usage Rights

Once the agreed payment has been made, clients receive a non-exclusive, worldwide, perpetual license to use the delivered video material for their music video project, including publication on social media, streaming platforms, websites, and other promotional or commercial channels.

Any exclusive rights or additional usage restrictions must be agreed upon separately.

Hemle35 retains its copyrights and other intellectual property rights to the extent permitted by law.

The client is responsible for obtaining the necessary rights to any music, logos, artwork, or third-party materials they provide.

The video production fee does not automatically include music licensing or other third-party licensing fees.

10. Portfolio & Promotional Use

We love showcasing the projects we create.

Hemle35 may request permission to feature completed projects, selected clips, or behind-the-scenes material in its portfolio, showreels, website, or social media channels.

Any such use will be subject to the necessary permissions from the client and other relevant rights holders.

Booking our services does not automatically grant permission for promotional use.

11. Cancellation & Rescheduling

We understand that plans sometimes change.

If you need to cancel or reschedule, please contact us as early as possible so we can discuss the available options.

Rescheduling is subject to mutual agreement and availability.

If a booking is cancelled, the amount payable or refundable will be determined according to the applicable legal provisions, the services already performed, and any individually agreed valid cancellation arrangements.

Where German law on contracts for work applies, the client's termination rights and the corresponding remuneration rules under Section 648 of the German Civil Code (BGB) remain unaffected.

A payment made upfront does not automatically become non-refundable.

12. Consumer Right of Withdrawal

Consumers who book online may have a statutory 14-day right of withdrawal under German law.

Details of this right, how it can be exercised, and its legal consequences are provided in our separate Withdrawal Policy.

If a consumer expressly requests that services begin during the withdrawal period, statutory rules concerning payment for services already performed may apply.

Under the conditions set out in Section 356(5) BGB, the withdrawal right may expire once the service has been fully performed.

Nothing in these Terms & Conditions limits statutory consumer rights.

13. Third-Party Rights & Permissions

Clients must ensure they have the appropriate rights and permissions for materials, music, and other content supplied for their projects.

Necessary consent to film or publish identifiable people must be obtained in accordance with applicable law.

Both parties will cooperate to clarify responsibility for such permissions before production.

14. Liability

Hemle35 is liable without limitation in cases of intent or gross negligence, for injury to life, body, or health caused by legally attributable negligence, and wherever liability is mandatory under applicable law.

In cases of ordinary negligence involving an essential contractual obligation, liability for other losses is limited to foreseeable damage typical for the contract, to the extent legally permissible.

Statutory warranty rights and mandatory consumer protections remain unaffected.

15. Website Content

The photographs, videos, text, branding, and other original content published on this website are protected by applicable intellectual property laws.

Visitors may not reproduce, distribute, or commercially exploit protected website content without the necessary permission, except where permitted by law.

16. Applicable Law

These Terms & Conditions are governed by the laws of the Federal Republic of Germany.

For consumers residing outside Germany, mandatory consumer protection rights applicable in their country of habitual residence remain unaffected where required by law.
